Mark H. Gross

Mark has served as a healthcare consultant and as a claims counsel for close to three decades. He was a principal of Barnett, Ehrenfeld, Edelstein & Gross, PC and now is a senior member of the firm of Gross & Edelstein LLP.

Previously Mark also served as Director of Loss Prevention for Affiliated Risk Control Administrators, Inc. (ARCA) advising on risk issues encompassing medical, legal and engineering disciplines to numerous healthcare providers. His experience in the healthcare field has spanned three decades holding positions as an Assistant Executive Director of a local New York hospital, a Malpractice Loss Control Specialist with the Insurance Company of North America, and 26+ years as claims counsel and advisor to various healthcare systems. Mark graduated from Ohio State University College of Engineering with a Bachelor of Science Degree and from New York University School of Public Administration with a Masters Degree in Public Administration of Healthcare Policy, Planning and Administration. He earned a Juris Doctor Degree from Touro College School of Law and is admitted to the Bars in both New York and Florida

Mark holds the designation as a licensed Florida Healthcare Risk Manager. He is a guest lecturer on risk management issues to hospitals and medical providers. Mark was also a member of the adjunct staff of St Joseph’s College, teaching health-courses for its nursing program.

Since 1984 Mark has served as claims consultant and risk management advisor to Catholic Health East (now Baycare System) in Tampa, Florida which oversees ten hospitals and ancillary medical facilities. Mark is presently claims counsel and risk management advisor to Westchester Medical Center and several community based Hospitals. Mark previously served as claims counsel to Brookdale University Hospital Medical Center as part of the Combined Coordinating Counsel professional liability insurance program.

Edward Edelstein

Ed has worked with a variety of health care systems since 1978 including Montefiore Medical Center, the Hospital of the Albert Einstein College of Medicine, Bronx Lebanon Hospital and Beth Israel Medical Center in conjunction with providing services to FOJP Service Corp. Mr. Edelstein was at various times claims counsel to Long Island College Hospital, Our Lady of Mercy Medical Center, St. Luke’s Roosevelt Medical Center and The Brooklyn Hospital Center in conjunction with providing services to the Combined Coordinating Counsel professional liability insurance program.

He continues to provide claims consultative services to the University of Medicine & Dentistry of New Jersey (UMDNJ) since 1986. He also currently serves as claims counsel to Wyckoff Heights Medical Center and, together with Mark, is claims counsel to Westchester Medical Center.

Edelstein joined Ackerman, Salwen & Glass in 1978 and became a partner in 1986 and later was a principal in Barnet Ehrenfeld, Edelstein and Gross PC. Ed and Mark have formed the law firm of Gross & Edelstein LLP. Earlier, Ed had worked in the litigation division of the corporation counsel of the City of New York. His prior administrative experience includes serving as executive director of the National Collegiate Conference Association, Inc. from 1971 through 1974.

Ed graduated from Queens College the City University of New York with a Bachelor of Arts Degree before earning a Juris Doctor Degree from St. John’s University School of Law.

Our Team

As attorneys, we have extensive experience in the management of professional liability and general liability claims. As claims counsel we work with defense counsel to formulate settlement strategizes and often participate in settlement negotiations. While maintaining a collegial approach to litigation management, we are retained to oversee the efficient management of defense counsel resources to resolve claims in a cost effective methodology. Paramount to our management of health provider’s insuring/self insured program is the awareness of our client’s healthcare operations and the particular sensitivities that healthcare providers require for effective management of its claims.

The firm’s team of investigators all hold degrees in the healthcare profession. All of our investigators have substantial clinical experience, as well as intensive training in medical-legal issues.
